Terms and Conditions Agreement for Freedom Trailers LLC
By checking the box below, you ("Renter") agree to the following Terms and Conditions set forth by Freedom Trailers LLC ("Company"). These terms govern your rental of trailers and equipment from the Company and are legally binding.
- 1. Rental Period and Fees
The rental period begins when you take possession of the trailer or equipment and ends at the agreed-upon return date and time as specified in the rental agreement.
Renter agrees to pay all rental fees, taxes, and any additional charges (e.g., delivery fees, late fees, or cleaning fees) as specified in the invoice prior to taking possession of the equipment.
If the trailer is returned after the agreed-upon time, the Renter will be charged a late fee of $50 per day, plus any additional costs incurred by the Company due to the delay (e.g., loss of subsequent rentals).
a. Security Deposit
A refundable security deposit is required for all trailer rentals. The amount is clearly displayed with your rental totals on the checkout page.
This deposit helps cover any potential damage, excessive cleaning, late fees, or missing equipment. After we inspect the returned trailer, we will refund the full deposit (or release the credit card hold) within 7 business days if everything is in good condition. We may apply part or all of the deposit toward any amounts you owe. Any deductions will be itemized and explained to you.
2. Renter's Responsibilities
- Renter acknowledges that the trailer and any associated equipment are in proper working condition at the time of rental and assumes full responsibility for its use during the rental period.
Renter will return the trailer in the same condition it was received, except for normal wear and tear (e.g., minor scratches or dirt from regular use). Normal wear and tear does not include damage due to misuse, negligence, or accidents.
Renter is responsible for any damage to the trailer, equipment, or any third-party property that occurs during the rental period, including but not limited to dents, structural damage, tire blowouts, or towing-related issues.
If any damage, loss, theft, or malfunction occurs, the Renter agrees to immediately notify the Company within 24 hours and cover the full cost of repair or replacement, including labor, parts, and any downtime costs incurred by the Company.
Renter must operate the trailer in compliance with all applicable local, state, and federal laws, including traffic and towing regulations.
3. Liability
The Renter assumes full responsibility for any injury, loss, or damage to themselves, their passengers, third parties, or their property during the rental period, whether caused by accident, misuse, negligence, or otherwise.
Freedom Trailers LLC, its owners, and agents are not liable for any damages, injuries, losses, or expenses (including but not limited to medical costs, property damage, or lost wages) incurred by the Renter, their passengers, or third parties while the trailer is in the Renter’s possession or use.
The Renter acknowledges that towing and hauling carry inherent risks, and the Company is not responsible for any accidents, collisions, or damages resulting from the Renter’s operation of the trailer, including improper towing, overloading, or failure to secure loads.
4. Indemnification
The Renter agrees to indemnify, defend, and hold harmless Freedom Trailers LLC, its owners, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising from the Renter’s use, misuse, or possession of the trailer or equipment.
This includes, but is not limited to, claims related to personal injury, property damage, environmental damage (e.g., illegal dumping), or violations of laws (e.g., traffic violations, overweight fines).
5. Insurance Requirements
The Renter is responsible for maintaining adequate insurance coverage during the rental period, including auto liability insurance that extends to the trailer while towing.
The Company does not provide insurance coverage for the trailer, the Renter, or third parties. Any damage to the trailer, third-party property, or injuries will be the Renter’s financial responsibility.
Renter must provide proof of insurance upon request, and failure to maintain coverage does not relieve the Renter of liability.
6. Equipment Condition and Use
The Renter is responsible for inspecting the trailer and equipment prior to use and ensuring it is in good working order. Any existing damage must be reported to the Company before taking possession, or the Renter may be held responsible for it.
The trailer must be returned clean and in the same condition as received, excluding normal wear and tear. A cleaning fee of $50 will be charged if the trailer is returned excessively dirty (e.g., with debris, mud, or hazardous materials).
The Renter agrees not to use the trailer for illegal activities, transporting hazardous or prohibited materials, overloading beyond the trailer’s stated capacity (e.g., 10,000 lbs for the 7x14 dump trailer), towing with an incompatible or unsafe vehicle, or any purpose not disclosed to the Company at the time of rental. Violation of these terms may result in additional fees, termination of the rental, and full liability for any resulting damages.
7. Cancellation and No-Show Policy
Cancellations made less than 24 hours before the rental period will incur a 50% cancellation fee of the total rental cost.
Failure to pick up the trailer at the scheduled time (no-show) will result in a 100% charge of the rental fee.
8. Governing Law and Dispute Resolution
This agreement is governed by the laws of the State of Florida. Any disputes arising from these terms will be resolved in the courts of Brevard County, Florida.
The Renter agrees to waive any right to a jury trial and consents to the jurisdiction of Florida courts for all claims related to this agreement.
9. Force Majeure
The Company is not liable for failure to provide the trailer due to circumstances beyond its control, including but not limited to natural disasters, government restrictions, or equipment failure.
10. Customer Account Requirement
Effective immediately, all customers must create a free customer account to rent trailers or equipment from Freedom Trailers LLC. Guest checkout is no longer available.
Creating an account allows us to manage your rentals more efficiently, provide faster service for future bookings, maintain accurate records, and better handle any outstanding balances. This change helps us deliver a smoother experience for all our valued customers in the Brevard County area.
11. Marketing Communications
By creating an account or renting with us, you may receive occasional emails from Freedom Trailers LLC about promotions, new trailer availability, special offers, or important rental updates.
You can opt out of marketing emails at any time by clicking the unsubscribe link in any email or by contacting us directly. We respect your preferences and will not share your email with third parties for marketing purposes.
12. Outstanding Invoices and Future Rentals
Renter agrees that any unpaid invoices, including but not limited to rental fees, late fees, damage charges, cleaning fees, or any other amounts owed to Freedom Trailers LLC, must be paid in full before the Renter is permitted to rent any trailer or equipment again. The Company reserves the right to refuse any future rental requests until all outstanding balances are settled in full. Renter further acknowledges that continued non-payment may result in the account being placed with a collections agency and/or reported to credit bureaus where permitted by law.
13. Entire Agreement
This agreement constitutes the entire understanding between the Renter and Freedom Trailers LLC and supersedes any prior agreements or understandings.
The Company reserves the right to modify these terms at any time, with updated terms applying to future rentals.
